I hope I’m wrong
On Sunday, Feb 9, 2025, on Bluesky, I timidly asked, “I hope I’m wrong, but it looks like they are trying to get rid of the judiciary. Hitler set up Special Courts. Can we stop another Hitler?” That was in response to JD Vance’s post on X, “Judges aren’t allowed to control the executive’s legitimate power.”
On Feb 10, 2025 we learned that a federal judge in New Hampshire has ruled that the White House has violated his order to unfreeze billions of dollars in federal grants.
In response, again on Bluesky, I posted: “One week or two?...til they either freeze the judiciary altogether, or else keep the loyalist judges and establish Special Courts.”
How many lawsuits can we file in three weeks?
There are some 40 lawsuits that have been filed in opposition to Trump administration orders in the last three weeks. Jamie Raskin is now calling for a class-action suit filed by all Americans pursuant to the 1986 Computer Fraud and Abuse Act (CFAA).
Good luck with that, Congressman.
While I believe Democrats and organizations who have been harmed by the executive orders are right to pursue legal remedies, judicial action lacks immediacy. Judicial remedy in the case of data theft has always presented a conundrum in that irreparable harm is done once the data has been accessed and disseminated.
Musk is fearless and undeterred
And yet, Musk & The Musketeers work on, seemingly fearless and undeterred. (Note: Contrary to offering the opportunity to verify information that was posted on Bluesky, I will not hyper-link to X out of respect for many readers’ desire to not affiliate with Musk’s social media platform.) On February 10, 2025, on X, Rep. Dan Goldman posted: “It wasn’t just a freeze on @elonmusk and @DOGE accessing American’s personal data. He was ordered to DETROY any data they already took. Elon must confirm he has followed the court order.”
NJ Attorney General Matt Platkin commented on Goldman’s post: “To be clear: the Judge ordered Elon and the DOGE bros to delete any data they illegally acquired since Trump took office. We are going to make sure they comply…”
Elon Musk then commented: “We don’t have any personal data of Americans, you corrupt moron.”
Dan Goldman: “Tell it to the judge under oath.”
They aren’t just trying to sell your personal data to Amazon, ya know
Elon may be telling the truth. It is possible that they no longer have the data. It may have already been transmitted to god knows who or where.
So what’s the rush? Why not just wait for the wheels of justice to grind at their own pace?
Answer: we don’t have the luxury of time.
According to reports in The Washington Post and in The Hill, the purpose for accessing the data in various governmental agencies is to teach AI generative software the information and processes so that humans and entire governmental departments will be replaced en masse.
Musk is using the information to teach AI systems how to replace our human workforce
While we wait for court orders, and wait longer for Musk’s compliance with court orders, our entire government is rendered unrecognizable as it is being re-ordered under an authoritarian and non-human regime.
On Bluesky on Feb 7, 2025, when Florida Congressman Maxwell Frost noted that guards were denying entry to the Department of Education by members of Congress, Elon Musk replied: “No such department exists in the federal government.”
My point: A judicial order is a piece of paper, at best. (Technically, in the year 2025, it is an electronic transmission that could be printed if desired.) A court order is apparently irrelevant in the face of Musk’s ongoing technological terrorism. We are waiting for a bully’s compliance with court action while congressionally-approved departments are quickly being annihilated and a total restructuring of our government’s workforce is carried out.
They have worked for decades to get the courts to line up on their side
The next step, as I see it, is to simply dispose of the distraction of the 40-something lawsuits and their potentially pesky orders. Why not simply take over the courts so that they can get the rulings they want?
The takeover of our court systems has been contemplated for decades. The most blatant display was the refusal by Mitch McConnell to even consider an Obama nominee to the Supreme Court when Scalia died. Since then there have been three Republican-appointed justices (Gorsuch, Kavanaugh, and Barrett). Though Biden appointed a total of 228 judges to district and appellate courts, but that number will likely be eclipsed when Trump begins adding to the 226 he appointed in his first term. Along the way we have seen an erosion of precedent at the Supreme Court level, notably in the rulings on abortion. And with the SCOTUS gift on the powers of immunity granted to the president, all of what is going on is entirely legal. The Trump administration, with the court’s blessing, can do all of what has been done.
But as we see, even though Trump has tried to pack the courts to the best of his ability, the appointment of hundreds of hand-picked judges is not an iron-clad guarantee of favorable rulings. We must begin to contemplate that Trump will seek extra-judicial remedies if he continues to hit rulings like those handed down on the birthright citizenship case and in the judicial order to pause the freeze on federal funding.
Hitler’s Special Courts
Will Trump go the route that Hitler did, and establish a parallel court system that co-exists with the established system until an eventual point at which there is a overt realignment with MAGA idealogy?

Do you give it one week or two?
We’ve not even logged a full month since Trump’s inauguration. Do you give it one week or two before we start to see him set up a parallel judiciary that gives him reliable rulings to quiet the naysayers?

As usual, you write SO clearly---how---can more people read and absorb what you are writing about??? VERY frustrating to have you be so valuable and yet????
